Thank you for engaging with vacatly (hereinafter "we," "us," or "our") through our fashion platform or related services (collectively, the "Services"). By accessing, using the Services, or participating in any vacatly-initiated activities (e.g., tagging our official accounts, sharing content featuring our products), you agree to be bound by the following terms and conditions ("Terms").

"User Content" means any content you create, post, or share in connection with the Services, including but not limited to text, images, videos, usernames, profile information, and tags.

Eligibility & Participation

1) To use the Services or participate in vacatly activities, you represent and warrant that:

①　You are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher);

②　You have the legal capacity to enter into these Terms;

③　If participating in location-specific campaigns, you are a legal resident of the eligible region(s) specified in campaign details.

2) Participation is voluntary and does not create a partnership, joint venture, or employment relationship with vacatly. We reserve the right to restrict or terminate access to any user who fails to meet eligibility requirements.

User Content & Intellectual Property

1) You warrant that all User Content is original to you, or you have obtained valid permission from the rights holder(s) to use and share it. User Content must not infringe on third-party rights (e.g., copyrights, trademarks, privacy) or violate applicable laws, Platform rules, or these Terms.

2) By sharing User Content that references vacatly (e.g., tagging our accounts, featuring our products), you grant us a non-exclusive, worldwide, royalty-free, perpetual, and sublicensable license to:

①　Use, reproduce, adapt, modify, display, distribute, and incorporate your User Content into marketing materials, advertisements, websites, social media, and any current or future media.

②　Attribute your User Content where practicable (e.g., tagging your username), unless you request otherwise in writing.

3) All trademarks, logos, and content owned by vacatly (e.g., product images, website text) are protected by intellectual property laws. You may not use them without our prior written consent.

Waiver of Claims

By submitting User Content, you irrevocably waive any and all claims against vacatly, its affiliates, and partners related to:

1) Use of your name, image, likeness, or User Content as permitted under these Terms;

2) Alleged infringement of publicity rights, privacy rights, or intellectual property;

3) Indirect, incidental, or consequential damages arising from the use of User Content, to the fullest extent permitted by law.

User Obligations & Conduct

1) You agree to use the Services in compliance with these Terms, applicable laws, and Platform rules.

2) Prohibited conduct includes (but is not limited to): posting false or misleading content, engaging in fraud, harassing others, or attempting to hack or disrupt the Services.

3) You shall indemnify and hold vacatly harmless from any losses, liabilities, or claims arising from your breach of these Terms or improper use of the Services.

vacatly Rights & Limitations

1) We reserve the right to review, remove, or refuse to use any User Content at our sole discretion, without notice, for any reason (e.g., violation of these Terms).

2) We are not obligated to feature, store, or maintain User Content, and we may modify or discontinue any campaign or Service feature at any time.

3) vacatly is not liable for:

①　Unauthorized use of User Content by third parties (including third-party platforms or other users);

②　Errors, delays, or interruptions in the Services;

③　Losses resulting from your reliance on User Content or the Services.

Privacy

Your use of the Services is subject to our privacy policy, which explains how we collect, use, and protect your personal data (e.g., contact information, browsing activity). By agreeing to these Terms, you consent to the practices described in the Privacy Policy.

Third-Party Platforms

Our Services may interact with third-party Platforms (e.g., social media sites), but we are not affiliated with, endorsed by, or responsible for these Platforms. Your use of Platforms is governed by their respective terms of service.

Changes to These Terms
